Sometimes disputes over real estate arise even if great care was exercised in putting the original documents together. Other times documents are put together at the kitchen table with the best of intentions, and the results are left to those who come after, seeking an answer to the eternal question, “What were they thinking?”

Verbal agreements regarding real estate do end up in court sometimes, however, and the arcane concepts of “unjust enrichment,” “implied contract,” and “constructive trust” come into play.
